We process your personal data exclusively to offer the following functionalities of the App and to manage your orders.
This includes the following processing activities, which are described in detail below:

  • Operation of the app
  • Inclusion in our nationwide agent network, as well as the optional import function from your existing Google account or Facebook account
  • Administration and order management of your agent activity
  • Contacting our service team
  • Use of additional functionalities of the app on your end device, such as microphone, camera and push messages.

 App operation

When operating the app, the following personal data is processed:

  • IP address
  • Device identifier of your end device (e.g. UDID – Unique Device Identifier)
  • Device information (e.g. device type or iOS version)
  • Geoposition (optional) of your end device

This data is anonymised before it is stored. This information is analysed for statistical purposes and in case there are technical problems. We do not reveal the identity of individual users for this purpose.

Inclusion in our nationwide agent pool

The following personal data are processed in detail for the registration:

  • Personal data (first and last name*, age, gender*)
  • Communication data (telephone number* and e-mail
    address*)
  • Address data (postcode* and city*)
  • Agent data (order perimeter and experience)

If you have a Google account or Facebook account, you can import the data marked with * above, provided that this data is stored there. For this purpose, the following data will also be transmitted to the service provider:

Administration and order management of your agent activity

The following data are processed for the administration of the orders:

  • Written answers and photos within the visit questionnaires
  • Number of accepted / completed ordersTime stamp (last login)
  • Log data (date / time stamp last login, actions performed)
  • Other data, e.g. the contents of emails, invoices and other documents outside the app.

Use of additional functionalities of the app on your end device

Depending on the selected functionality, the app accesses the following functions of your mobile device

  • Microphone and speech recognition (collection of speech and conversion into text)
  • Camera and photo library (take or upload order photos)
  • GPS receiver (collection of your position to determine the distance to orders)
  • Push messages (active sending of information and orders to your device).

Access to functionalities of your mobile terminal is only granted if you yourself initiate it, for example by activating voice recognition to make an entry or by recording your location to have the distance to an order displayed.

You can change the access of the app in the settings of your mobile device for the various functions at any time. To do this, go to the settings of the end device and then to the app settings.

When switched off, you can no longer fully use the corresponding functionalities for the ImmoAgent app. You will be asked during registration and, if applicable, during further use whether you wish to allow access.

Purpose and legal basis of the processing

We use data that you provide to us in the context of your orders for the fulfilment of our contractual obligations towards you and our customers pursuant to Article 6 (1) lit. b DSGVO.

If you use the option to import your data from your Google account or Facebook account, this is done on the basis of consent pursuant to Article 6 (1) a DSGVO.

If service providers are used on behalf of the operation, maintenance and/or support activities, this is done in accordance with Article 28 of the GDPR.

Recipients and categories of recipients

We use service providers as processors for the provision of the app. We ensure that these service providers are carefully selected, continuously monitored and contractually bound in accordance with data protection requirements. We only use service providers in third countries if they have committed to following appropriate data protection standards when processing your personal data.

The following service providers are used to operate the app

  • Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA (All data is processed in Microsoft Azure Germany. The IT service provider T-Systems International GmbH (T-Systems International GmbH, Hahnstraße 43d, 60528 Frankfurt am Main) is used as data trustee. This means that Microsoft Inc. itself does not have access to the data. Further information can be found under the following link.)
  • etventure GmbH, Ackerstraße 14-15, 10115 Berlin (The service provider supports the data controller in the context of maintenance and support activities and has insight into personal data of the data controller).

When registering as an agent in the app, you can import
your profile data from your Facebook profile or your Google account. In doing so, the respective service provider learns that you are using our app.

In the process, your login data is transmitted to the respective company and the data is imported from your account into our database via an interface.

Transfer of your data to a third country or international organisation including the guarantees of processing

Your login data for using the import function will be transferred to Facebook Inc. or Google LLC. in a third country based on your consent pursuant to Article 49(1)(b) DSGVO. The respective data protection guidelines of the service providers apply.

Duration of processing

Insofar as necessary, we process your personal data for the duration of our business relationship, which also includes, for example, the initiation and execution of a contract. In addition, we are subject to various storage and documentation obligations, which result from the German Commercial Code (HGB) and the German Fiscal Code (AO), among other things. The retention and documentation periods specified there are generally six to ten years.

Data subjects’ rights

You have various rights when dealing with your personal data, such as the right to information about the data we have stored about you or the right to correction, restriction of processing, the right to data portability, the right to object or deletion of your data.

Upon request and under the conditions of Art. 17 DSGVO, your data will be deleted unless we are entitled or obliged to further use it.

Under the conditions of Art. 18 of the GDPR or if deletion is not possible, you can demand that data processing be restricted. Right to data transfer: regulated in Art. 20 DSGVO. Upon request, we will make your stored data available to you in accordance with Art. 20 DSGVO.

If the processing of the data is based on consent pursuant to Art. 6 para. 1 lit. a, this consent can be revoked at any time with effect for the future.

You have the right to lodge a complaint with the following supervisory authority if you believe that our processing of your personal data violates the applicable data protection laws: Berlin Commissioner for Data Protection and Freedom of Information, An der Urania 4-10, 10787 Berlin.

Consequences of non-provision

Within the scope of our business relationship, you only have to provide those personal data that are necessary for the establishment, execution and termination of a business relationship or that we are legally obliged to collect. Without this data, we will usually have to refuse to conclude the contract or execute the order or will no longer be able to perform an existing contract and may have to terminate it.

Automated decision / profiling

You can activate the sending of so-called push messages in the settings. You will then always receive a push message when new orders are available in your area. This is determined by the postcode you entered and your individually entered order radius. You can deactivate the sending of push messages in the settings of your mobile device at any time.

Encryption of the data

When transferring your personal data, this is done exclusively via an encrypted connection with our service provider.

5.1 Applications

5.1.1 Type and scope of processing of personal data

For the application via our job portal, a form is provided in which data relevant to the application must be entered.

These include:

5.1.2 Purposes and legal basis of the processing of personal data

The entry of their own personal data enables applicants to submit their application data and online to us. The data is processed exclusively for application purposes. 5.1.3 Duration of storage

The data will be stored until the application process is completed. If the applicant has consented to be included in the talent pool, his/her application data will be deleted after a further 6 months, unless an extension is requested.

5.1.4 Right to deletion, objection and correction

You have the right to request information from us at any time about the data we have stored about you, as well as its origin, recipients or categories of recipients to whom this data is passed on and the purpose of the storage. You can object to the
use of your data for the aforementioned purposes at any time with effect for the future, without incurring any costs other than the transmission costs according to the basic rates. Please send all requests for information or objections to data processing to us by e-mail.

Unfortunately, we cannot consider any application from you without your application documents.

6 Analysis tools, remarketing and targeting

6.1 Google Analytics

6.1.1 Type and scope of processing of personal data

We use the Google Analytics component (with anonymisation function) on this website. Google Analytics is a web analysis service. Web analysis is the collection, compilation and evaluation of data about the behaviour of visitors to websites. A web analysis service collects, among other things, data about the website from which a data subject has accessed a website (so-called referrer), which sub-pages of the website have been accessed or how often and for how long a sub-page has been viewed.We use the add-on “_gat._anonymizeIp” for web analysis via Google Analytics. By evaluating the data obtained, we are able to compile information on the use of the individual components of our website. This helps us to continuously improve our website and its user-friendliness. These purposes are also our legitimate interest in processing the data according to Art. 6 para. 1 lit. f DSGVO. By anonymising the IP address, your interest in the protection of your personal data is sufficiently taken into account.

Data is deleted as soon as it is no longer needed for our recording purposes. Due to long sales processes and a customer journey lasting up to 2 years, we retain our data for 26 months.

Personal data is transferred to a third country. Google LLC is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law pursuant to Art. 45 DSGVO (link).

You can prevent the setting of cookies by our website at any time by means of an appropriate setting of the Internet browser used and thus permanently object to the setting of cookies. send & collect user data for our service process. When you request a quote, the data provided during registration is transferred to Webflow and processed there. You can object to the storage at any time, have your data deleted or request information about your data.

The length of the data storage period depends on your order status. If you only request a quotation, we will store your data for a period of 2 years. In the case of execution by us, the period is extended to up to 15 years in order to be able to grant the full product warranty claims.

7.1.5 Right to deletion, objection and correction

You can object to the storage, have your data deleted or request information about your data at any time.

7.1.6 Right to deletion or restriction according to Art. 17 and 18 DSGVOUpon
